The Government of Alberta Introduces Bill-30 to amend the Condominium Property Act

On November 4, 2024, the Government of Alberta introduced Bill 30, known as the Service Alberta Statutes Amendment Act, 2024. If enacted, this bill seeks to enhance governance, accountability, and dispute resolution within condominium communities. It specifically addresses the challenges encountered by the condominium sector, such as managing shared spaces, financial responsibilities, and community involvement standards.

If passed, some of the key changes that Bill 30 proposes include:

  • Condominium Dispute Resolution Tribunal: Establishing an affordable and accessible tribunal to resolve disputes. The tribunal is intended to be an alternative to taking disputes to court.
  • Chargebacks: Establish that chargebacks, if authorized by bylaws, are contributions, which may be levied by a corporation against condominium owners who are directly responsible for incurring costs – for example, because of damages – to ensure the chargebacks are paid:
    • treating chargebacks as contributions means there can be consequences for non-payment, just as there can be for the non-payment of condo fees
  • Strengthen Consumer protections: Enhancing consumer protections (for example, by bringing in a technical analysis requirement for new condominiums)
  • Improving condominium Governance: (for example, through meeting and voting procedures).

In addition, if Bill-30 passes it would also make it easier for workers in the Construction sector by:

  • Establishing prompt payment rules and processes for Government of Alberta construction projects through amendments to the Public Works Act
  • Keeping money flowing through the construction chain in private and public projects
  • Making clarifying amendments to remove ambiguities from the Prompt Payment and Construction Lien Act

What’s Next:

Bill 30 is set to undergo the legislative process, enabling public feedback and modifications before its enactment. If approved, the Tribunal might be established as soon as 2025, initiating a new phase of condominium governance in Alberta. We will share more updates as they become available.
